Corrupt Judge, forced to resign, seeks change to Georgia’s Constitution

Georgia currently does not allow any form of citizen-initiated ballot measures, so all ballot measures must be referred by the legislature.

On November 8th four Constitutional Amendments will be on the ballot.  Amendment 3 abolishes the existing Judicial Qualifications Commission and requires the General Assembly to replace it with a new Judicial Qualifications Commission and provide for the composition, manner of appointment, governance, powers and duties, procedures, and open meetings of such reformed commission, with such commission having the power to discipline, remove, and cause involuntary retirement of judges as provided in the Constitution, and for Supreme Court review of the commission’s opinions and procedures. It amends Article VI, Section VII, Paragraph VI and Article VI, Section VII, Paragraph VII of the Georgia Constitution.”

In other words, it will abolish the currently independent Judicial Qualifications Commission and replace it with one governed by the General Assembly.  I see a problem with this, especially when I look at the fact that State Representative Johnnie Caldwell co-sponsored this Amendment.

State Representative Johnnie Caldwell used to be Fannin County Superior Court Judge Johnnie Caldwell, who was District Attorney Johnnie Caldwell prior to that.  He was also forced to step down from the bench because the Judicial Qualifications Commission was investigating him for allegations of sexual misconduct in his courtroom and chambers.  Judge Caldwell abruptly stepped down, writing in his resignation letter to the governor that he wanted to spend more time with his grandchildren. He also promised the Judicial Qualifications Commission that he would never run for judge again.

But he didn’t promise “not” to run for The State House of Representatives.  So he did, and he won.  Now it appears he is using that seat to exact revenge on the Commission that forced his resignation and bring it under the control of lawmakers such as himself.

I still know a few judges around the state, and I’ve discussed this issue with several of them.  The general consensus is this is a bad amendment.  One flatly stated, “It’s bullshit”.

In the last 10 or so years, more than 60 corrupt Georgia judges have left the bench because of their misconduct, and their resignations have been largely a direct result of investigations by the Judicial Qualifications Commission.  Personally, I’m a little disappointed some of them weren’t prosecuted, but that’s for another day.

Allowing the General Assembly to create a “NEW” Judicial Qualifications Commission would not only violate the principle of “If it ain’t broke, don’t fix it”, it would allow Legislators of Caldwell’s ilk to control that Commission.

So I’m asking my friends and others who agree, to make sure you get to the polls on November 8th and vote NO on Proposed Constitutional Amendment 3.  The question on the ballot will read:

Shall the Constitution of Georgia be amended so as to abolish the existing Judicial Qualifications Commission; require the General Assembly to create and provide by general law for the composition, manner of appointment, and governance of a new Judicial Qualifications Commission, with such commission having the power to discipline, remove, and cause involuntary retirement of judges; require the Judicial Qualifications Commission to have procedures that provide for due process of law and review by the Supreme Court of its advisory opinions; and allow the Judicial Qualifications Commission to be open to the public in some manner?

( ) YES

( ) NO

Rett Syndrome and CBD

Yes, Puff is beginning to exhibit symptoms.  It is truly terrifying to see the changes in her over the last few months.  Stage II, or the rapid destructive stage of Rett, usually begins between ages 1 and 4.

What is Rett Syndrome?  It is a neurodevelopmenal disorder that affects girls almost exclusively.  Rett syndrome is estimated to affect one in every 10,000 to 15,000 live female births and crosses all racial and ethnic groups worldwide.  It is characterized by normal early growth and development followed by a slowing of development, loss of purposeful use of the hands, distinctive hand movements, slowed brain and head growth, problems with walking, seizures, and intellectual disability.   Currently it is not possible to make reliable estimates about life expectancy beyond age 40.

60% to 80% of Rett victims develop epilepsy.  Thankfully, that hasn’t happened with Harlee yet and prayerfully, it won’t, but you can see that the odds are stacked against her.  On the flip side, since she has not yet developed epilepsy, she is ineligible for treatment under HB1, the Haleigh’s Hope Act.

If HB722 passes, Rett will be covered for the use of CBD Oil, since it involves seizures and epilepsy.  That’s according to Representative Allen Peake.  That’s great news, but HB722 still has to pass.  I pray it does.  No parent should have to “wait” until a Legislative body decides if their child’s condition meets an arbitrary “criteria” and can have access to what that very Legislative body has already recognized as medicine.  That’s a decision a Doctor should make.

Ironically, Harlee’s grandfather is the Chief Deputy of Wheeler County Ga.  I haven’t had the opportunity to discuss this with him yet, but that discussion is surely coming, if he’ll allow it.  I wonder how well he’ll toe the Georgia Sheriff’s Association’s line when it comes to his own son’s child?

Here’s to you Puff, and to all the others who suffer from Rett.  I pray first that the symptoms will diminish and you’ll lead a normal, happy life.  I pray secondly that, if the course of the condition continues as usual, our Legislators will move to bring safe access to Georgia, and thus to you.

Recently I came in contact with some folks from The Families of Sick Patients in Georgia.  This collective has formed to fight for expansion of Georgia’s House Bill 1, The Haleigh’s Hope Act. Sign the Petition

This is Jagger Cotte, a 5 year old Georgia child suffering from Leigh Syndrome.  Leigh syndrome is a severe neurological disorder that typically arises in the first year of life. This condition is characterized by progressive loss of mental and movement abilities (psychomotor regression) and typically results in death within a couple of years, usually due to respiratory failure.

It is a “24/7 struggle” for Jagger’s parents just to keep him alive, according to Sebastien Cotte, Jagger’s Dad.  Thanks to Allen Peake’s HB1, the Cottes can now legally possess CBD Oil and administer it to Jagger, but Governor Nathan Deal’s gutting of the original bill poses a serious dilemma for them.

Peake’s original Bill contained language for in-State cultivation of Medical Marijuana.  Governor Deal just wasn’t, and still isn’t, having that.  This becomes a very real problem for the folks who are on Georgia’s Medical Marijuana Registry and can legally possess CBD Oil.  That problem is, they cannot gain access to the CBD Oil in Georgia without violating Federal Law!!  Now, there is some debate about whether Hemp products containing < .3% THC can legally be shipped across State lines.  The Federal Farm Act of 2014 section 7606 “seems” to allow it, but the language is not specific to mailing, rather to “sales”.  Looking at that legislation as a retired LEO I’m pretty sure the DEA could push a case of Interstate Transportation if they really wanted to.  To quote my old Granddaddy, “That ain’t good, boy!”

Jagger’s treatments consist of a combination of CBD Oil & a THC content higher than allowed by HB1.  So the Cottes temporarily  moved to Colorado for a year, far from their home in Georgia, because Georgia has, well I’ll just say it, the “STUPIDEST” law ever written for CBD access.

In Colorado the Cottes, of course, made contacts sympathetic to their plight.  They have now moved back to Georgia.  As I chatted with Sebastien Cotte he said “We can get [Jagger’s] CBD by mail now, but his THC is much more complicated since it can’t be mailed.  Obviously I don’t talk too much about how we get his THC”.  He also said “I am able to get what I need because I made some connections when we lived in CO, but most parents in GA are in a bad situation until Deal allows in State cultivation”.

The Georgia Commission on Medical Cannabis recently voted down in-State cultivation, largely because of testimony by representatives of the Georgia Sheriff’s Association and Georgia Bureau of Investigation.  Apparently these Law Enforcement types are “afraid” that legal, in-State cultivation would be too hard to monitor and enforce.   They’re also afraid that it will lead to Marijuana grows (like there aren’t tons of it being grown in GA each year already).  Macon Telegraph Coverage

I watched all the Commission on Medical Cannabis testimony through a live stream from the Hearing Chamber and the further along it got the more I could see in Rep. Peake’s eyes that he wasn’t liking what he was hearing.  Partially because of that vote, Representative Peake resigned from Governor Deal’s Legislative team and has decided to fight, from his House of Representatives Seat, for the in-State cultivation his original Bill called for.  I say BRAVO Mr. Representative!!!  Peake steps down

So, we’re set for a battle here in Georgia in 2016, between Deal’s threatened veto of ANY legislation regarding in-State cultivation and Peake’s determination to make in-State cultivation a reality .  Sadly, the lives of children, like Jagger, and the adults in Georgia who desperately need this medicine hang in the balance.  What’s also in the balance is the clean criminal records of the parents and caregivers.

So without further ado, I hereby award my First Annual Asshat Award to Governor Nathan Deal.  I’m sure the crown will fit him well.

Prohibition vs Prohibition

Good Stuff

I’m in a story telling mood, so here we go.  I ran across this whiskey in Nebraska.  It had a small pamphlet attached to the neck, which I read.  Here’s the story.

Templeton Rye refers to rye whiskey originally made in Templeton, Iowa during the prohibition era as a way for farmers in the Carroll County area to supplement their income.[1] Amber in color, it was considered to be of particularly high quality and was popular in Chicago, Omaha, and Kansas City speakeasies.[2] It was said to be the mobster Al Capone‘s drink of choice.  (Wiki of course, but the story on the pamphlet is the same.  Why retype it?)

I dug a little deeper.  During prohibition, so the story goes, this WHOLE TOWN (population 373 in 1920), whose farms had supplied grain to a now defunct liquor industry, decided to start distilling whiskey with the grain they grew, since they no longer had a market for it.  That whiskey turned out to be so fine that Al Capone labeled it “The Good Stuff”.  A town of less than 400 people, devastated by the ratification of the 18th Amendment, defied Federal Law to survive and caused the coining of the phrase “gimme the good stuff”.

What a great story of American determination to be free! Of pursuing what is becoming the “illusive” American Dream based on Life, Liberty and the Pursuit of Happiness by providing a quality product to a demanding public.

I’m not much of a drinker these days.  Alcohol has caused me a lot of personal relationship problems.  I have been a bad husband at times because of it.  It took me a while to look myself deep in my own eyes about that and I didn’t like the man staring back at me when I finally did.

So, I try to keep a bottle of this around for the occasional chance I get to share a shot of it and this story with a new friend, but those shots are few and far between.

I also keep a little bit of medical “chronic” around.  I use it a lot more often that the rye 😉.

I’d go to the VA with symptoms, they’d do some tests, say “take 2 and call me in 3 months”.  Like the “good soldier” I was I said thanks, saluted smartly and took the poison they were pumping into me. (Gonna blog about the VA soon)

Amazingly, though marijuana has “No Known Medical Use”, all the symptoms that caused me to have to swallow all that crap went away over a period of time, so I just quit ordering them.  (Those Norcos sell for 5 – 8.  I was steady getting 90 a month for $9.00.  It was tempting, mighty tempting, but I’m not a felon.  I’m not a criminal at all.)

I think it’s a damn shame we didn’t learn anything from the 18th and 21st Amendments.  As a matter of fact we REGRESSED!  The 18th Amendment didn’t prohibit the possession or consumption of alcohol.  The War on Marijuana does, so it’s never been a War on Drugs, it’s always been a War on People.

Look, I know it’s not a cure all.   I still have days I hurt, but the euphoric effect of the THC makes it easy to deal with what pain I do have. The kicking legs, the night terrors and the depression associated with two heart attacks, and a triple bypass are all gone.  I feel like getting out and being active again.  I’ve lost close to 90 pounds and my Type 2 diabetes is gone.  I know what it’s done for me.

I also know it may not be everyone’s cup of tea, but it should be EVERYONE’S CHOICE.  It’s all about FREEDOM to be able to use this as the safe, natural medicine that it is without government interference.

Whole Plant Legalization and Me

I’m 65 in January.  An honorably retired veteran and LEO, I have never been arrested and my record of service to both my country and community are unassailable.

I’m a chronic user of chronic who used it to stop a 5 year run with legally prescribed opiates, among other meds. I don’t care that it’s illegal, it’s a misdemeanor.  the-most-dangerous-thing-about-mj-pot-weed-death-died-killed-article-size

 

The VERY worst thing they can do to me for <oz is give me a year in county (and they’ll HAVE to do it because I ain’t pleading to SHIT). Crank the wheels down on that “jury of my peers”. Even if they DO convict, I’m a cop and they’ll have to put me in my own cell. They can’t deny me access to exercise so I will have the yard all to myself. By the end of week one I’ll be a favorite of the trustees (if I’m not a trustee) and I’ll have everything I could get on the outside.  Maybe they’ll let me cook!!

I am sick to death of watching our young people’s lives ruined over a plant. I am sick to death of the uneducated (that’s right) masses buying into the HYPE of reefer being bad for you. That’s what happened under the 18th Amendment with alcohol, ya know. People got sick of it. GW Pharma and Georgia

I saw this meme today and thought, “Interesting, but I’m gonna check that out before commenting”.  Annnnnnnnnnnnnnnnd I did!

This is a bit lengthy, but stay with me.  I think there is a huge lesson in weed-onomics and Government Corruption in this.

Turns out this meme is based on factual information, which we are warned about in this pamphlet.  The more of this pamphlet I read the confuseder (intentional misspell) I got.

Then I just got righteously  angry.

I’ll try to keep this in order with the page numbers, but some of the lines blur.

From page 4:
“Warnings and precautions:
Talk to your doctor or pharmacist before using Sativex:
• If you are pregnant or plan to become pregnant.
• Whether male or female you must use a reliable contraceptive method while using this medicine (see also “Pregnancy, breast-feeding and contraception (men and women)”, below).
• If you are under 18 years of age. • If you have epilepsy or regular fits (seizures).
• If you have liver or kidney problems.
• If you have a serious heart problem such as angina, a previous heart attack, poorly controlled high blood pressure or a problem with your heart rate or heart beat.
• If you are elderly, especially if you have problems doing everyday activities such as making hot food and drinks.
• If you have previously abused any drug or substance.
If any of the above apply to you (or you are not sure), talk to your doctor or pharmacist before using Sativex”.

Pretty straight forward.  My only comment is “Too bad they don’t attach that warning to every bottle of alcohol distilled, brewed or fermented”.  (* watch the asterisks, they’ll connect later on)”

“Other medicines and Sativex:
Tell your doctor or pharmacist if you are using or have recently used
or might use any other medicines. This is because Sativex may affect the way some other medicines work. Also, some other medicines can affect the way Sativex works.

In particular, tell your doctor or pharmacist if you are using any of
the following medicines:
• Medicines that reduce anxiety (sedatives) or make you sleep
better (hypnotics). These medicines may increase the side
effects of Sativex and may increase the risks of falls and other
accidents.
• Medicines to relax your muscles such as baclofen or diazepam.
This is because taking Sativex with these medicines may
increase the risk of you falling over.

If any of the above apply to you (or you are not sure), talk to your
doctor or pharmacist before using Sativex.
If you see a different doctor or go into hospital, let them know all

Layman’s terms “THC is an effective anti-anxiety treatment. It is also an aid for insomnia and muscle relaxation. Don’t use Sativex if you are already using a Big Pharma poison that has the same medicinal qualities as THC.”

• In general, alcoholic beverages should be avoided whilst using
Sativex especially at the beginning of treatment or when
changing dose. If you do drink alcohol while using Sativex,

stable, you should still not drive or use machinery if Sativex
causes effects such as sleepiness or dizziness that could impair
your ability to perform these tasks. If you are not sure, do not
drive or operate machines.
The medicine can affect your ability to drive as it may make you
sleepy or dizzy.
• Do not drive while taking this medicine until you know how it
affects you.
• It is an offence to drive if this medicine affects your ability to
drive
• However, you would not be committing an offence if:
-The medicine has been prescribed to treat a medical or dental
problem and
-You have taken it according to the instructions given by the
prescriber or in the information provided with the medicine
and
– It was not affecting your ability to drive safely”

Let’s pick that apart some!!

SAY WHAT? The active ingredient in this medication is MARIJUANA for God’s sake!!! (** … pesky asterisks)
Ask ANYONE involved in the Criminal “JustUs” System in Georgia what would happen, ohhhhhhhhhhh, let’s say if you were hit by another vehicle and blood tests were done. They would CHARGE YOUR ASS WITH DUI.

So not only are they stealing our medicine so they can charge exorbitant prices for it (***), they’re giving us BAD LEGAL ADVICE!!!! (Which is a Felony, unless you are an Attorney.  If you’re an attorney it is perfectly normal [sorry Catherine Bernard, et al]).

(Author’s aside:  This “medicine” is not yet approved by the FDA, so I assume this references Brit or Canadian law, not U.S. law)

“Sativex contains ethanol and propylene glycol
• Sativex contains about 50% v/v of ethanol (alcohol) i.e. up to
40 mg per dose. The amount of alcohol in the maximum daily
dose for most people (12 sprays) is about the same as found in
two teaspoons (10 ml) of beer and about one teaspoon (5 ml)
of wine. This product can be harmful for those suffering from
alcoholism.

• Sativex contains propylene glycol which may cause irritation.
Symptoms of irritation are pain, itchiness, dry cough, sore throat”

So, even though they warn against drinking alcohol earlier in the pamphlet, they now tell us that 50% of this “medicine” is alcohol?  (* – another connection)  Makes complete sense to ME [sarcasm emphasized]!!

It can be HARMFUL to alcoholics because of the alcohol content!!

It contains propylene glycol (foreign to the “Natural” form) that can cause pain, itchiness, dry cough and sore throat.

Now, I’ve had Strawberry Cough and Raspberry Cough and I’ve coughed my lungs out taking too big a toke on a new strain (****) but I’ve NEVER had BUD cause pain, itchiness, dry cough or a sore throat!!

From page 12 – This is where I really started to get heated up
“Working out how much to use
The number of sprays you need each day depends
on you as an individual. Each person needs a different number of
sprays to give them the best relief from their muscle stiffness,
with the fewest unwanted effects”. 

So if you get a prescription for Sativex (main ingredient Delta9 THC), you have to determine your own dosing?

Ohhhhhhhhhh WAIT ….. let’s start looking at some anomalies at this point.

One of the primary arguments against medical marijuana in Georgia is the issue of dosing.  Yet here is a THC based BigPharm “medicine” that says to “work your own dosage out“!

A different GWPharm “medicine”, Epidiolex is being used in research done by Dr. Yong D. Park at Georgia Regents in Augusta.  Epidiolex is CBD based.  Dr. Park just happens to be on the Deal appointed Georgia Commission on Medical Cannabis.  Here’s a self-serving article Dr. Park wrote for The Atlanta Journal Constitution concerning CBD vs THC.  In this article he states:
It’s important to note cannabis-derived oil is not medical marijuana, which is typically a dried form of the marijuana plant administered by smoke or vapors, or added to foods or drinks. Medical marijuana contains all components of the marijuana plant, including cannabidiol, THC and many other compounds“.

He also stated:
Last year, through a public-private partnership involving the state of Georgia; GW Pharmaceuticals, a United Kingdom-based company, and Georgia Regents University, the Georgia Cannabidiol Study began at the Children’s Hospital of Georgia. Children are being enrolled at Children’s Hospital and at study partner sites in Atlanta and Savannah for an expanded 50-person trial“.

So GWPharm is funding Dr. Parks’ research, Dr. Parks considers medical marijuana as the plant form, and the company sponsoring his research has a THC based “Medical Marijuana” oral spray it’s trying to get past the FDA in the United States.

So they take a plant which is beneficial to us in its natural state,  having no known serious side effects, they extract the Delta9 THC and CBD from it, mix it with some other stuff and create a “medicine” that causes mouth ulcers for 1 in 10 users?  Amongst other serious side effects?  And expect us to just be OH FUCKIN’ KAY with it?

 I want to start this off by saying that I am a true Son of the South.  I am Alabama born and bred.  I KNOW my heritage.  I can name Civil War Battles.  I know where there are old Confederate Armory ruins around my neck of Alabama.  I can tell you that Montgomery AL was the first Capitol of the Confederacy.  That the Confederacy was BORN in Montgomery AL, created by the union of South Carolina, Mississippi, Florida, Alabama, Georgia, Louisiana, and Texas in secession from the United States.  My “Rebel Yell” is just as good as anyone’s and I can sing “Dixie” better than most!.

I lived through the troublesome times of racial disparity.  I saw the “colored only” drinking fountains.  I saw the “white only” restroom signs with my own eyes.  I saw the police brutality to African-Americans gathering in numbers to demand their Civil Liberties as Americans.  I saw the Southern Cross flown to protest school integration.  I saw it on black-and-white television and I listened to it on the radio.  I saw the water hoses turned on our brothers and sisters in Birmingham.  I saw the dogs released.

How can anyone with any common sense or any knowledge of Southern History say that this flag represents their heritage only and does not also represent hate?  How can folks who claim it as their “heritage” not see this?

I don’t give a rat’s ass about a flag, any flag.  Flags are only pieces of cloth, but they are divisive by nature.  They set countries and people APART and put them at odds with each other.  What I care about is Peace, Understanding and Tolerance.  And recognize this;  The Civil War, War of Northern Aggression, War to Free the Slaves, whatever you choose to call it, divided families.  The rights or the wrongs of the issues that caused that war are immaterial.  The fact is that brother was pitted against brother, father against son.  This stupid shit has me at odds with my own son!!  We were arguing the other day about it and I said “If this is about heritage name me three battles of the Civil War”.  He couldn’t do it!!!!  If you are supporting the “heritage” of the Southern Cross, don’t you think you should know something about that heritage?

Also recognize that this particular bit of foolishness is accomplishing exactly what the FED wants.  They want us divided!!!  Remember “United We Stand, Divided We Fall”?  This issue distracts us from the REAL issue, which is an overbearing government that wants us completely under its thumb and will accomplish it through DIVISIVE ACTIONS.

If there is not some sanity and reason restored about this, there will be bloodshed over it.  That will be played up by mainstream media, which will stir up more emotion.  Then there will be more violence and bloodshed.  The Guard will be called out first.  If they can’t get peace restored, the Feds will step in and it’ll all be over but the crying.  THEY want a race war!!!!

There is no RIGHT side of this issue.  I’m proud of my Southern Heritage, not because of the Confederacy, but because my people were (and are) good, hard working folks who believe in Freedom, Faith, Family and Friends.  I learned to milk a cow when I was 7.  I learned to plow a mule when I was 9.  I helped my Granddaddy and Daddy farm.  I saw how they fed an extended family.  I saw the cooperation within that very large family.  Our heritage is NOT about that flag.  It is about the love that we had for each other, our neighbors and the Good Lord.

We had kinfolk that died fighting for the Confederacy.  I’m proud they took the stand they did.  But we also have kinfolk that fought for Old Glory in WWII, Vietnam and the Desert and I’m equally as proud of the stand they (and I) took.  THAT’s a part of our heritage too.

What I’m saying is “This is a damned silly thing to be arguing over when we have SO many other issues that are SO much more important.  Fly your flag if you want to, no matter which one it is, but recognize that others will view YOU in the light of what THEY think that flag represents and that YOU are just walking into the trap the Fed has set for us.  America is in distress, and the only way to fix it is to cooperate with each other in a spirit of unification against an oppressive government that knows VERY WELL that if WE THE PEOPLE ever get it together, they are done”.
